These Terms of Service (“Terms”) govern your access to and use of the Genogram Builder application (“Service,” “App,” or “we/our”) operated by FireGuy.NET. By creating an account, logging in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance and Eligibility
You must be at least 13 years of age (or the age of digital consent in your jurisdiction, whichever is higher) to use the Service. By using the Service you represent that you meet this requirement and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Account Registration and Security
You must register for an account to save and manage genograms. You may create an account using your email and a password, or by signing in with Google or Sign in with Apple (where offered). Use of those third-party sign-in options is also subject to the respective provider’s terms and privacy policy. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your password (if you have one) and for the security of any linked sign-in method (e.g., Google, Apple), and for all activity under your account. You must notify us promptly at genogram@fireguy.net of any unauthorized use of your account.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service in any way that violates applicable laws or regulations;
- Infringe the intellectual property, privacy, or other rights of any third party;
- Transmit malware, viruses, or other harmful code;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems or networks;
- Use automated means (e.g., bots, scrapers) to access the Service except as we expressly permit;
- Interfere with or disrupt the integrity or performance of the Service;
- Use the Service to harass, abuse, defame, or harm others;
- Resell, sublicense, or commercially exploit the Service without our written consent.
We reserve the right to suspend or terminate your access if we reasonably believe you have violated these Terms or applicable law.
4. Your Content and Data
You retain ownership of the content and data you create or upload (e.g., genograms, names, notes). By using the Service you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely to operate and provide the Service to you (e.g., hosting, backups, sharing when you choose “public”). We do not claim ownership of your content and do not use it for marketing or unrelated purposes. You are solely responsible for your content and for ensuring you have the right to include any personal or sensitive information about others; see our Privacy Policy for how we handle data.
5. Intellectual Property
The Service (including software, design, text, graphics, and our trademarks) is owned by FireGuy.NET or its licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service or its underlying technology except as necessary to use the Service in the normal manner. “Genogram Builder” and related marks are used for the operation of this application.
6. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. The genogram tool is intended for personal, educational, and professional support use (e.g., counseling, family-systems work) but is not a substitute for specialized clinical or medical software or professional advice. Use of the Service and any reliance on its output is at your sole risk.
7. Limitation of Liability
To the maximum extent permitted by applicable law, FireGuy.NET and its operators, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, goodwill, or business opportunity) arising out of or related to your use or inability to use the Service, even if advised of the possibility of such damages. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the fullest extent permitted by law.
8. Indemnification
You agree to indemnify, defend, and hold harmless FireGuy.NET and its operators, affiliates, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your content or data; (c) your violation of these Terms or applicable law; or (d) your violation of any third party’s rights.
9. Termination
You may stop using the Service at any time. You may delete your account and associated data through the account settings in the Service. We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (including 5–8 and this sentence) will survive termination.
Inactive accounts. The Service is provided free of charge. To keep the Service sustainable for active users, we require that you sign in at least once every 365 days. If your account has been inactive for 335 days or more, we will send one warning email to your registered address. You then have 30 days from the date of that email to sign in. If you do not sign in within that 30-day period, we will permanently delete your account and all associated genogram data. We recommend exporting or backing up any data you wish to keep before it is deleted. This policy does not apply to accounts we designate as administrators.
10. Changes to the Service and Terms
We may change, suspend, or discontinue features of the Service at any time. We may also modify these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Material changes may be communicated via the Service or by email where appropriate. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and may delete your account.
11. General
Governing law: These Terms are governed by the laws of the United States and the State where the operator is located, without regard to conflict of law principles.
Disputes: Any dispute arising from these Terms or the Service will be resolved in the courts of competent jurisdiction in that State.
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and FireGuy.NET regarding the Service and supersede any prior agreements.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
